Welcome to Kino Collectibles. These Terms of Service ("Terms") govern your use of our website, services, and the purchase of any trading cards, collectibles, or related products (collectively, "Products") from us. By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services or purchase Products.

2. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any significant changes, such as by posting the new Terms on this page. Your continued use of the service after any such changes constitutes your acceptance of the new Terms. Please check back periodically to review the latest version of the Terms of Service.

3. Products and Services

3.1 Product Authenticity and Condition

We strive to accurately describe and photograph all Products. However, due to the nature of trading cards and collectibles, slight variations in color, condition, or other details may occur. All descriptions of Products are subject to change at any time without notice, at our sole discretion.

The condition of trading cards is subjective and based on professional assessment (e.g., PSA, Beckett, CGC grades) where applicable, or our internal grading standards. By purchasing a graded or ungraded card, you acknowledge and accept the inherent subjectivity in grading.

3.2 Pricing and Availability

All prices are subject to change without notice. We reserve the right to limit the quantities of any Products or services that we offer. We reserve the right to discontinue any Product at any time. In the event a Product is listed at an incorrect price due to a typographical error or error in pricing information received from our suppliers, we shall have the right to refuse or cancel any orders placed for the Product listed at the incorrect price.

3.3 Consignment and Selling Services

If we offer consignment or selling services, specific terms and agreements for those services will be detailed in a separate document provided to the user, known as the Consignment Service Policy.

4. Ordering and Payment

4.1 Order Acceptance

Your submission of an order constitutes an offer to purchase the Product(s). All orders are subject to acceptance by us. We may, in our sole discretion, limit or cancel quantities purchased per customer, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address.

4.2 Payment Security

We use third-party payment processors to handle payment transactions. We do not store your credit card information. You agree to comply with the terms and conditions of the third-party payment processor.

4.3 Taxes and Fees

You are responsible for any applicable taxes, duties, customs fees, or other charges imposed by governmental entities in connection with your purchase.

5. Shipping and Delivery

5.1 Shipping Liability

Risk of loss and title for Products purchased from us pass to you upon our delivery to the carrier. We are not responsible for any shipping delays, losses, or damage incurred after the carrier takes possession of the items.

5.2 International Shipping

For international orders, you are responsible for all customs, duties, and import fees. We are not responsible for any delays caused by customs processing.

6. Returns and Refunds

Please review our separate Store Policies: Transparency in Business 1 Return Policy document which is incorporated by reference into these Terms. In general, all sales of trading cards and collectibles are considered final, except as expressly stated in the Return Policy.

7. Intellectual Property

All content on the site, including but not limited to text, graphics, logos, images, digital downloads, and data compilations, is the property of Kino Collectibles or its content suppliers and protected by international copyright laws.

8. User Conduct

You agree not to use our services:

• For any unlawful purpose.

• To solicit others to perform or participate in any unlawful acts.

• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances.

• To submit false or misleading information.

9. Limitation of Liability

In no case shall Kino Collectibles, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product.

10. Indemnification

You agree to indemnify, defend, and hold harmless Kino Collectibles and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

11. Governing Law

These Terms of Service and any separate agreements whereby we provide you Products shall be governed by and construed in accordance with the laws of the State/Province of Connecticut and the United States.
